Throughout these Terms, “Travel By Cook,” “we,” “us,” and “our” refer to Travel By Cook and Robert Cook. “Traveler,” “you,” and “your” refer to the person using this website, requesting travel-planning services, or making a reservation through Travel By Cook.

By using this website, submitting an inquiry, requesting a quote, approving a proposal, or authorizing a reservation, you agree to these Terms and Conditions.


1. Travel By Cook’s Role

Travel By Cook provides travel research, planning, reservation assistance, and related support as an independent travel advisor affiliated with KHM Travel Group.

Travel By Cook does not own, operate, manage, or control the airlines, cruise lines, hotels, resorts, tour operators, transportation companies, excursion providers, insurance companies, or other businesses that provide the components of your trip. These businesses are referred to in these Terms as “travel suppliers.”

Travel By Cook acts as an intermediary between you and the travel suppliers selected for your trip. Each travel supplier maintains its own terms, conditions, payment requirements, cancellation policies, and privacy practices. Your reservation may be subject to additional agreements provided by Travel By Cook, KHM Travel Group, or the applicable travel supplier.


2. Eligibility and Authority

You must be at least 18 years old and legally capable of entering into a binding agreement to request or authorize a reservation.

When you provide information or approve travel arrangements for another person, you confirm that:

  • You have permission to act on that person’s behalf.

  • The information you provide is accurate and complete.

  • You have shared these Terms and all applicable supplier terms with that person.

  • You accept responsibility for communicating reservation details, payment deadlines, cancellation policies, and travel requirements to everyone included in the booking.

The person who authorizes the reservation may be treated as the primary contact for all travelers included in that reservation.


3. Quotes and Proposals

Travel quotes and proposals are based on the information available at the time they are prepared. Unless specifically stated otherwise, a quote does not guarantee availability, pricing, room category, cabin assignment, airfare, promotions, or other travel components.

Travel prices can change without notice until the reservation is confirmed and any required payment has been received and accepted by the applicable supplier.

A proposal may include estimated taxes, fees, gratuities, resort charges, fuel supplements, baggage charges, transfers, insurance, or other expenses. Unless an item is specifically identified as included, you should not assume it is part of the quoted price.

Exchange-rate changes may affect the final cost of international travel arrangements.


4. Planning Fees and Deposits

Travel By Cook may charge a professional planning fee or request an upfront planning deposit for customized, complex, international, group, or research-intensive itineraries.

Any applicable fee or deposit will be explained before work begins. Unless otherwise agreed in writing:

  • Planning fees compensate Travel By Cook for research, consultation, itinerary design, and professional time.

  • A planning deposit may be credited toward the final amount when the qualifying trip is booked through Travel By Cook.

  • Planning fees may become nonrefundable after research or itinerary work has begun.

  • A planning fee does not guarantee that a particular price, promotion, property, flight, or itinerary will remain available.

Supplier commissions, when applicable, are paid by travel suppliers and do not change the traveler’s responsibility for any separately disclosed planning or service fee.


5. Reservation Approval

You are responsible for carefully reviewing all quotes, proposals, invoices, confirmations, and travel documents before authorizing a reservation.

Before approving a booking, verify that the following information is correct:

  • Legal names of all travelers

  • Dates of birth

  • Travel dates

  • Departure and arrival locations

  • Flight times and airports

  • Cruise ship, sailing date, and cabin

  • Hotel, resort, and room category

  • Package inclusions and exclusions

  • Accessibility or accommodation requests

  • Total price

  • Deposit and final-payment deadlines

  • Cancellation and change policies

Traveler names must match the identification or passport that will be used during travel. Corrections made after booking may result in supplier fees, fare increases, ticket cancellation, or the need to make a new reservation.

Your written, verbal, or electronic approval authorizes Travel By Cook to make the approved arrangements and submit the applicable payment information to the travel supplier or payment processor.


6. Payments

Payments may be processed directly by a travel supplier, KHM Travel Group, an authorized payment processor, or another approved booking platform.

By providing payment authorization, you confirm that:

  • You are the cardholder or have permission from the cardholder.

  • The billing information is accurate.

  • You authorize the specified charges.

  • You understand the applicable payment, cancellation, and refund policies.

Deposits and final payments must be received by the deadlines shown on your invoice or confirmation. A supplier may cancel a reservation automatically when payment is not received on time. Travel By Cook is not responsible for a cancellation caused by an expired card, declined transaction, incorrect payment information, insufficient funds, or missed payment deadline.

Prices may be adjusted if a supplier identifies a pricing error, tax change, government-imposed fee, fuel supplement, currency adjustment, or other charge permitted under its terms.


7. Supplier Terms

Every reservation is subject to the applicable travel supplier’s terms and conditions. Supplier terms may address:

  • Deposits and final payments

  • Cancellation penalties

  • Refund eligibility

  • Travel credits

  • Name changes

  • Itinerary changes

  • Baggage

  • Check-in requirements

  • Conduct

  • Age restrictions

  • Accessibility

  • Health requirements

  • Documentation

  • Liability limitations

  • Dispute procedures

By approving a reservation, you agree to review and follow all supplier requirements provided with the quote, invoice, confirmation, ticket, or travel documents.

When these Terms differ from a supplier’s terms regarding a supplier-provided service, the supplier’s terms generally control that portion of the reservation.


8. Changes, Cancellations, and Refunds

Requests to change or cancel a reservation must be submitted to Travel By Cook in writing.

A request is not complete until Travel By Cook or the applicable supplier confirms that the change or cancellation has been processed. Leaving a voicemail, sending a message, disputing a charge, or failing to travel does not automatically cancel a reservation.

Changes and cancellations may result in:

  • Supplier penalties

  • Nonrefundable deposits

  • Fare differences

  • Change fees

  • Loss of promotional benefits

  • Planning or service fees

  • Reduced or unavailable refunds

  • Future travel credits with expiration dates or restrictions

Refunds are determined by the applicable supplier’s policies. Travel By Cook cannot require a supplier to issue a refund, exception, waiver, or travel credit when the supplier’s terms do not provide one.

When a refund is approved, processing times are controlled by the supplier, payment processor, or financial institution. Travel By Cook is not responsible for delays after an approved refund request has been submitted.

Professional planning fees and fees for services already performed may remain nonrefundable even when a supplier provides a refund or travel credit.


9. Price Changes and Promotions

Travel promotions are subject to availability, eligibility requirements, blackout dates, booking deadlines, and supplier restrictions.

A lower price discovered after booking does not automatically entitle you to a refund or adjustment. Travel By Cook may request a price adjustment when permitted by the supplier, but approval is not guaranteed. A lower advertised price may involve different dates, accommodations, room or cabin categories, fare rules, cancellation terms, or included services.

Rebooking to obtain a lower price may result in the loss of deposits, promotions, onboard credits, resort benefits, seat assignments, room selections, or other reservation features.


10. Travel Documents and Entry Requirements

You are responsible for obtaining and carrying all documents required for your trip, including:

  • Passports

  • Visas

  • Government-issued identification

  • Birth certificates

  • Parental consent documents

  • Vaccination or health records

  • Entry or transit authorizations

  • Proof of onward travel

  • Any documents required for minors

Passport, visa, health, and entry requirements can vary based on citizenship, residency, destination, transit country, age, and type of travel.

Travel By Cook may provide general information or direct you to official resources, but you are responsible for confirming the requirements that apply to every traveler in your party. Final decisions regarding entry, boarding, immigration, and documentation are made by government authorities and travel suppliers.

Travel By Cook is not responsible when a traveler is denied boarding or entry because of missing, expired, damaged, or insufficient documentation.


11. Health, Safety, and Destination Information

Travel involves personal and financial risks. Conditions at a destination may change before or during a trip.

You are responsible for reviewing current information relating to:

  • Health conditions and vaccination requirements

  • Weather and natural disasters

  • Crime and personal safety

  • Political or civil conditions

  • Local laws and customs

  • Accessibility

  • Transportation

  • Travel advisories

  • Medical facilities

  • Insurance coverage

You are responsible for determining whether a trip, activity, destination, or accommodation is suitable for your health, mobility, experience, and personal circumstances.

Travel By Cook does not provide medical, legal, immigration, or financial advice.


12. Travel Insurance

Travel insurance is strongly recommended because deposits, fares, and other trip costs may be partially or completely nonrefundable.

Travel insurance may provide coverage for certain cancellations, interruptions, medical emergencies, evacuations, delays, baggage issues, or other covered events. Coverage varies by policy, and exclusions, limits, deadlines, and documentation requirements apply.

Travel By Cook may provide information about available insurance products but does not guarantee that a policy will cover a particular event or claim. Coverage decisions are made solely by the insurance provider.

You are responsible for reading the policy and determining whether it meets your needs. Some benefits, including certain preexisting-condition waivers or cancel-for-any-reason options, may require purchase within a limited period.

You may be asked to accept or decline travel insurance in writing. Declining insurance means you accept responsibility for losses that could have been covered by an available policy.


13. Air Travel

Flight schedules, aircraft, routes, seat assignments, and fares may be changed by the airline at any time.

Travel By Cook does not control airline operations and is not responsible for:

  • Delays or cancellations

  • Missed connections

  • Schedule changes

  • Aircraft substitutions

  • Seat changes

  • Baggage loss or damage

  • Airline staffing or operational decisions

  • Additional costs caused by disruptions

You are responsible for checking your flight status, completing check-in, arriving at the airport on time, and complying with airline and security requirements.

When air travel is booked separately from a cruise, tour, hotel, or package, the other supplier may not provide compensation if a flight disruption causes you to miss part of the trip.


14. Cruises, Tours, Resorts, and Excursions

Cruise lines, tour operators, resorts, and excursion providers may change itineraries, ports, schedules, activities, accommodations, transportation, or other services for operational, weather, safety, regulatory, or commercial reasons.

Published photos, maps, descriptions, and itineraries are provided for general reference. Renovations, maintenance, seasonal conditions, construction, closures, or substitutions may affect the experience.

Travel By Cook will make reasonable efforts to communicate material changes received from a supplier but cannot guarantee that every change will be known before travel.

Activities and excursions may involve physical demands or risks. You are responsible for reviewing participation requirements and determining whether an activity is appropriate for you and the travelers in your party.


15. Accessibility and Special Requests

Tell Travel By Cook about mobility needs, disabilities, dietary restrictions, allergies, medical equipment, or other required accommodations before booking.

Travel By Cook will communicate reasonable requests to suppliers but cannot guarantee that a request will be available or fulfilled unless the supplier confirms it in writing.

Standards for accessibility, food preparation, transportation, and accommodations may differ by destination and supplier.


16. Traveler Conduct

Travelers must comply with all laws, supplier rules, health and safety requirements, and standards of conduct.

A supplier or government authority may refuse service, remove a traveler, or cancel an arrangement because of disruptive, abusive, threatening, unsafe, fraudulent, or unlawful behavior.

Travel By Cook is not responsible for costs or losses resulting from a traveler’s conduct or failure to follow applicable requirements.


17. Events Beyond Reasonable Control

Travel By Cook is not responsible for delay, interruption, cancellation, loss, or additional expense caused by circumstances outside its reasonable control, including:

  • Severe weather

  • Hurricanes, floods, fires, earthquakes, or other natural disasters

  • Pandemics, epidemics, or public health emergencies

  • War, terrorism, civil unrest, or political instability

  • Government orders or border closures

  • Labor strikes

  • Transportation disruptions

  • Supplier insolvency

  • Utility, telecommunications, or technology failures

  • Cyberattacks

  • Changes in law

  • Any similar event beyond Travel By Cook’s reasonable control

When one of these events occurs, the applicable supplier’s policies will determine whether refunds, credits, substitutions, or changes are available.

Travel By Cook works to provide useful and accurate website information. Travel information changes frequently, however, and website content may become outdated.

Website content is provided for general informational purposes and does not create a guaranteed offer, reservation, or professional relationship.

Travel By Cook may correct errors, update information, change services, or remove website content at any time without notice.

Travel By Cook is not responsible for indirect, incidental, special, punitive, or consequential losses, including lost enjoyment, lost income, lost business opportunities, or expenses resulting from circumstances outside Travel By Cook’s reasonable control.

When Travel By Cook is found directly responsible for a loss, its total liability will not exceed the amount of professional planning or service fees paid directly to Travel By Cook for the specific reservation giving rise to the claim, unless applicable law requires otherwise.

This limitation does not apply to liability that cannot legally be limited or excluded.


24. Your Responsibility for Losses

You agree to be responsible for losses, claims, penalties, or expenses resulting from:

  • Information you provided that was false, inaccurate, or incomplete

  • Your unauthorized use of another person’s payment method

  • Your failure to comply with supplier rules or travel requirements

Contact Travel By Cook promptly when you have a question or concern about a quote, reservation, payment, supplier, or travel experience.

When a problem occurs during travel, notify Travel By Cook and the applicable supplier as soon as reasonably possible. Delaying notice may limit the available options for correcting the issue.

Before filing a legal claim, both parties agree to make a reasonable, good-faith effort to resolve the dispute informally.


28. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, any legal proceeding relating to these Terms, the website, or Travel By Cook’s services must be brought in a court with proper jurisdiction in the Texas county where Travel By Cook maintains its principal place of business.


29. Time Limit for Claims

To the extent permitted by law, a claim against Travel By Cook must be submitted in writing within one year after the event giving rise to the claim.

This provision does not shorten a legally required filing period that cannot be modified by agreement.

Supplier contracts may contain different or shorter deadlines for claims relating to supplier-provided services.


30. Changes to These Terms

Travel By Cook may update these Terms when services, website features, business practices, supplier relationships, or legal requirements change.

The updated Terms will be posted on this website with a revised effective date. Changes apply to website use and new service requests after the revised Terms are posted.

A reservation already confirmed may remain subject to the version accepted at the time of booking, along with any applicable supplier terms.


31. Severability

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect. The invalid provision will be limited or modified only to the extent necessary to make it enforceable.


32. No Waiver

A delay or failure by Travel By Cook to enforce a provision of these Terms does not waive the right to enforce that provision later.


33. Entire Agreement

These Terms, the Privacy Policy, the approved proposal, payment authorization, invoice, supplier terms, and any additional written agreement relating to your reservation make up the agreement between you and Travel By Cook.

When a specific written booking agreement conflicts with these general website Terms, the specific booking agreement will control for that reservation.
